The Social Justice

in Islam

The discourse on the concept of social justice is very essential and important, for it is closely related to comprehension and understanding of Islam correctly, and confirming its actuality as a proper, valid system for governing all humankind, through presenting its exemplary project and methodology derived from its basic, main sources, the Holy Qur'an and the Prophetic Sunnah as well as the intellectual and jurisprudential products of its 'ulama' and learned scholars, who have directly benefited from the historical experience achieved on the ground of actuality and inferred the practical verdicts from its major sources. We, of course, believe that Islam is a methodical project which certainly suits all different times and developing ages, and harmonizes with the scientific and industrial progress, for it has flexibility and adaptability with the objective requirements of each time and age.

We believe, too, that any one of the secularists and their like, who have rejected and given up Islam, with the false excuse they release, that Islam does not suit our present time and its new problems and issues, they have surely misunderstood Islam correctly, and they have not gone deeply into its clear and pure sources so as to see the real fact that these essential sources have not let anything, unless they give it the proper verdict or judgement.

As a matter of fact, the problem is not in Islam itself, but the problem lays with us, for we do not know exactly how to benefit from its laws (tashri'at) and teachings. And this fact is represented by the famous maxim "People are enemies to whatever they ignore".

Therefore, we have to return to our religion (Islam), and look into its major texts attentively. Then we can have the right to judge it correctly whether it is valid and competent or otherwise. But, if we reject it without studying its texts carefully, this will show mere ignorance, obstinacy and injustice, or being away from establishing justice and equity.

ln fact, the social justice is the long -desired dream for humankind for thousands of years on this earth, where the oppressed people lived for a long time, hoping for attaining to the happy day on which they win victory over the tyrannical false deities (taghut), soothe the painful tears of the orphans, alleviate the groaning of the widows, satisfy the people's hunger, or feed the hungry and needy families, and break open the gates of the prison of oppression and injustice, and finally establish justice and equity in the community.

Anyhow, Islam, has prescribed and enjoined its new perfect tenets, teachings, laws and approaches which practically accord and harmonize with the internal nature of the human being and his real needs. Regarding this, Almighty Allah says in the Holy Qur'an:

"Then set your face upright for religion in the right state, the nature made by Allah in which He has made men, there is no altering of Allah's creation; that is the right religion…."

(Ar-Rum 30:30).

Moreover, Islam aims at respecting and honouring the human being Allah Almighty says:

"And surely We have honoured the children of Adam…, and we have made them excell by an appropriate excellence over most of those whom we have created". (17:70). Islam also considers him the viceroy (khalifah) of Allah Almighty, in the earth, and Allah has provided him with the necessary and essential things for reaching and attaining to his evolution, sublimity, and perfection. Allah Almighty says:

" O Dawood surely we have made you a viceroy (ruler) in the earth, so judge aright between men with justice". (38:26). As we know from the Holy Qur'an that the first khalif or viceroy or representative of Allah Almighty in the earth was Adam (A.S.)

Islam has also provided for human being the theories for establishing the real dignified social justice with all its dimensions, political, economical, judicial, moral or ethical, and so forth.

Development in the Means of Communications and Its Impact on the Actual State of Ifta' (Giving Legal Opinion)

Before any talk about the impact of the revolution of communication on the actual state of ifta' (giving legal opinion), we have to be very aware that we are dealing with one of the most dangerous transformations which is witnessed by the world throughout its history. Besides it is one of the exciting surprises in the twentieth century. It has not previously happened that the thoughts and views have got the chance to be worldwidely published and spread speedily, as it happens today in the shadow of the revolution of communication. So it has become essential and a must to deal with the achievements of this revolution, as it is considered the most important presence in the modern world of today. You are considered present when you are dealing with it, otherwise you are considered absent from the actual situation and isolated from the society, or you are beyond or away from the history.

As the case with every scientific and communication and information have provided for the human communities wonderful potentialities and capabilities for intercommunication among them. But, it is, however, like a two - bladed weapon. The human experience can employ these instruments and means for achieving the noblest and greatest aims and objectives, and others can employ them in the most destructive and miserable fields.

Hence, the question is raised, which is to be given more importance and interest by the religious preachers and propagators, not to engage in dealing with the origin of evil and wicked published works shown by the revolution of communication, but to deal more with the way of exploiting it for the goodness, or good deeds, beneficence, and building and constructive functions.

So it is a good chance, now for the du'at (holders of the religious messages, and preachers), propagators (muballighun) to benefit from the sophisticated and developed means of communication and mass media to communicate perfectly and properly, the tenets and teachings of Islam, and develop the position of ifta' correctly. By this, they can achieve a great success in this essential field.

Performing Congregational Prayers with the Sunnites

Whoever reads the biography of the Imams of Ahlul-Bayt (A.S.), and contemplates on their sayings and recommendations and advices, comprehends their great concern and care for the unity and solidarity of the Ummah closing ranks or joining them together to support each other, and getting rid of probable dissension, discord or division from its arena.

They did not encourage or enter into conflict and struggle to reach the sites of the authority and government, in spite of their being convinced with their deserving of their right, and the belief of the followers in their high , qualification and competence.

The Imams of Ahlul-Bayt (A.S.) also endeavoured, doing their best, for the sake of strengthening the entity of the Islamic Ummah, helping the khulafa' and the rulers of their time in bridging the gaps, and solving the problems, by presenting (to) them the views, counsel, advice and guidance.

The Imams have educated and trained practically their disciples and followers for taking care of the general interest of Islam and the Islamic Ummah, and conceding their own interests for the sake of the general ones.

They (A.S.), too, recommended their followers Shi'ah to go together with the other Islamic groups in the circles of the Islamic Ummah, and resist any attempt made by the tyrannical despots, for isolation, discord, or division between all the various groups of Muslim Ummah.

lt is true that the school of Ahlul-Bayt (A.S.) has its intellectual and jurisprudential specifications, but this does not mean the acceptance of the state of introversion and separation from the rest of the Islamic Ummah's body and its great entity.

As a matter of fact, the policy of union, unification and intercommunication has been established firmly by the lmams (A.S.), and it has achieved the best results and gains for the interest of Islam and the Ummah, and also for the goodness and interest of the school of Ahlul-Bayt (A.S.) as follows:

First: It has preserved the unity of the whole entity of the Ummah, and has forbidden the sectarianism in these ages to a high extent.

Secondly: It has caused the enemies and the despots to miss the opportunities of engaging the Ummah with the sectarian disagreements and divisions.

Thirdly: lt has given the school of Ahlul )Bayt (A.S.) to spread and stretch and expand its area inside the grand area of the Islamic Ummah.

From among the manifestations of this unitarian principled plan and wise policy of the Imams of

Ahlul-Bayt (A.S.), is their opinion and attitude of the taking part in the Muslim congreational prayers, in spite of the ideological, doctrinal and jurisprudential differences, and despite the problems and political pressures which were surrounding them and their followers.

This humble research, submitted for the noble reader is a survey and authentication or documentation for that unitarian Shar'i attitude, which I found a dire need for presenting it, to remind the Shi'ah of Ahlul-Bayt (A.S.) of the directives and guidelines of their Imams of guidance, and to give a brilliant and bright image of the biography of the lmams of Ahlu -Bayt An-Nubuwwah war- Risalah (Household of the Islamic Prophethood and Message).

The Balance between the Woman Rights and Duties on the Light of Islamic Delaration of Human Rights

First of all, we have to assure as a topic idea that Islam has opinionated first that the felicity of the human life has been established on the base of familial order or system, where the family forms the unit of the social building or construction, while rejecting absolutely the licentious, and libertine order which is really unrestrained, uncontrolled and disengaged. This is so , for two major affairs:

First: The stability of life and its perfect order depend on this order of marriage.

Second: Not all the human necessities are material necessities, but some of them are abstract or spiritual necessities which require satisfaction of fulfilment besides these needs.

Yet, if we can suppose that the licentious order can provide and fulfil the material needs, but it cannot satisfy the spiritual needs, which emanate from the importance of the elements of serenity, stability and mercy which are needed by the grown up people,so as to remove the dirts of the life from their souls and hearts. And the young people need them, too, to create an educational balanced influence in their self -constitution, where they can be nurtured on the bosom and lap of mercy serenity and tranquillity, provided for them by the mothers.

It is evidently proved through practical experience that the babies who have not lived and nurtured on the bosom and lap of the parents have lost much of the natural and spiritual growth.

So then, it seems clearly that the woman has a great role in providing the clean and pure family atmosphere, and the family and its formations as it has classical conception, well-known for all the communities and religions.

For these significant reasons, she (the woman) is considered the corner-stone in the process of the civilizatory development. Moreover, it is clearly seen that any blow directed towards the role of the woman in the referred family construction, and minimizing of the importance of the holy family tie or bond, or making an attempt to submit new concepts with modern claims, or weakening its ties, or creating a claimed alternative, are all considered as negative attempts, giving bad consequences and effects on the future of all humanity . And all these factors would cause it to miss the required advanced development. Rather it is a clear conspiracy on all the human existence, even though this terrible plot or conspiracy would come under the cover of the international service for the process of development and progress.
